The Texas Association of Schools Boards has awarded a prime contract for Job Order Contracting Services based on R.S. Means Facilities Construction Cost Data Unit Price Catalog. With this contract, a customer can obtain responsive, cost effective and value added facilities related construction, renovation, repair, and large maintenance services on an as needed basis to meet its recurring needs for facilities modification. Modeled after the job order contracts in use at several school districts in Texas and numerous federal facilities around the country, the Job order Contract offers a user access to a pre-qualified design build capable construction contractor to respond to emergency projects, assist in the clearance of a backlog of deferred maintenance activities, complete projects that were defaulted or cancelled, or “be available” to meet expected work influxes or augment a permanent facilities staff.

How to Utilize the
Job Order Contract
A Subscriber to the BuyBoard may obtain services under the JOC by contacting either the BuyBoard or Jamail & Smith Construction. Unlike traditional commodity type purchases where a quantity of supplies are ordered online and delivered by courier, the Job Order Contractor, upon notification, will schedule an appointment to investigate the work required and create a unit price estimate for the desired work along with project design planning (if required) and scheduling. In some cases a customer may wish to execute a series of job orders for a variety of facility needs-in that case the JOC Contractor will develop an execution plan for the basket of projects to be accomplished. A detailed cost proposal for the work (based on the BuyBoard Unit Price Book), along with a comprehensive work plan and alternatives will be presented for review by the customer within a short period after the project investigation.

The customer has full authority to review the proposal, modify scope with the contractor, and jointly develop an execution agreement. The Contractor will then prepare a BuyBoard Job Order which bilaterally obligates the contractor to the work and the customer to the execution, pricing and scheduling elements of the proposal. While the BuyBoard contract includes General Conditions which stipulate Contractor Performance Criteria, the customer may separately append its local terms and conditions to the job order for compliance by the Contractor. Upon execution of the job order, the job order contractor then executes the project in the standard method required by the customer, and bills the customer directly. The contractor furnishes the administrative reporting requirements for all work performed to the BuyBoard, though the contract is between the JOC Contractor and the Customer. The BuyBoard Contract is furnished at NO Cost to the user. All costs of utilizing the BuyBoard contract are represented by the final unit price estimate prepared by the Contractor and agreed by the Customer-there are no separate fees or administrative costs to the Project.
The Benefits
Job Order Contracting has been in practice with the Military since 1986 and the State of Texas since 1992. It is ideally suited to facility owners with several million square feet of facility and a regular requirement to maintain, modify, or repair those facilities to meet the ongoing needs of its customers. School Districts, Universities, and other public agencies, by virtue of the number of people employed and served and a changing role of those agencies to meet current service trends, often have a large number of smaller projects that cannot be accurately predicted on a quarter to quarter basis. Further, these unpredictable project requirements often arise with short deadlines or tight budgets. Access to a proven job order contract can greatly increase your organization’s responsiveness in meeting short fused projects. Having access to a competent construction contractor to assist in project planning can reduce the overall cost of a project by utilizing real time estimating techniques and a realistic viewpoint of the price of work and the complexities a project may handle. While several larger institutions throughout the State of Texas have sufficient facility and project needs to justify their own dedicated job order contract, most agencies in Texas have fewer facilities and a less regular need for project accomplishment.
